AGREEMENT TO TERMS

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.
We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.

You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.
By using the Site, you represent and warrant that:

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
COLOURS, SPECIFICATIONS, DIMENSIONS AND DESCRIPTIONS OF PRODUCTS
We make every effort to display the colours, specifications, dimensions and descriptions (please note all images are for illustration purposes only.) of items on the Website as accurately as possible. The colours you see will depend on the resolution of your monitor. We cannot guarantee that your monitor's display of any colour will always reflect accurately the colour of the item delivered. We may from time to time vary the dimensions, specifications, descriptions and quantities of items displayed on our Website without prior notice.
AJ The Confectionist reserves the right to substitute it with an item of equal or greater value than the original or issue a refund for the product. This applies to Gift Boxes and mixed orders.
If you live in the European Union you have a right by law to withdraw from the purchase of any item within a "cooling-off" period of seven working days starting on the day after the day the item is delivered to you ("Cooling-Off Period"). This right applies to all items advertised on the Website except for:
Products are invoiced in GBP sterling at the price prevailing at the time you place your order. Whilst we try and ensure all details, descriptions and prices are correct when appearing online, some products might be subject to slight variations. Errors & omissions excluded.
Delivery charge is an additional cost. Please refer to our Delivery Information for full details. Although we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
Prices displayed on the Website apply to online purchases only. They are not indicative of the price of identical items purchased in our store or by any other means. We reserve the right to update prices displayed on the Website at any point.
You may pay for the items which you order online by supplying your credit/debit card details on the secure online order form.
AJ The Confectionist operates the highest level of security, meaning your card details are processed through an encrypted secure payment gateway. Should we need to issue a refund due to a price change or item being out of stock we will need issue a refund via your original payment method.
We regret that we cannot accept cheques or cash as payment online.
Please note that we cannot guarantee the security of data when communicating AJ The Confectionist via email. We therefore ask you not to share your personal information or your payment details when sending us an email. For details of the security measures we employ please read our Privacy Statement. We will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us with when placing an order.
If you wish to cancel your order, please contact our Customer Service Department. As we try to process orders immediately it may not always be possible to prevent an order from being dispatched. If your order has already been dispatched, you may return the items to us in accordance with our Returns Policy or or email us at: firstname.lastname@example.org
As soon as we receive notice of your cancellation of an item we will refund the relevant part of the purchase price for that item together with the item's normal postage charge We cannot refund any priority, express or courier component of the postage charge. This only applies if the order is cancelled prior to dispatch.
Deliveries made Monday - Friday. Where possible all orders placed between Monday - Thursday will be delivered within 3 - 5 working days between 9am - 5.30pm.
Delivery: Standard Delivery
Standard deliveries to UK addresses are made within 3-5 working days.
We make every effort to dispatch items on time. If we are unable to deliver the items within your chosen arrival period, we will aim to contact you to discuss your options and dispatch as soon as possible. If the items are not delivered within the time period, we specify in the Confirmation Email, please contact our email@example.com quoting the order reference contained in your Order Confirmation Email.
Delivery occurs when the items are delivered to the delivery address you specified when placing your order. At this point, responsibility for loss, breakage and damage passes to you. Should you specify at point of order that goods are left with a neighbour, this is done so at your own risk. All goods must be signed for upon delivery.
Despatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
Hampers, Wine gifts and other items may be delivered separately.
Returns: Items damaged in transit
If you take delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item(s) to us within 30 days of taking delivery.
Returns: Defective items
You have the right to return a faulty item within 28 days along with proof of purchase.
Returns: Incorrect Items
If we have sent you an incorrect item, please notify our firstname.lastname@example.org as soon as possible or within 28 days and return the incorrect item to us and specify the correct details in writing. If you would like us to replace the incorrect item with the item, you ordered we will send you the correct item as soon as possible or alternatively we will refund the item once it has been returned. We will not charge you for the incorrect item and we must have the incorrect item returned before investigating.
We will be responsible for any losses you suffer as a direct result of us breaching these On-line Shopping Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for the sale of items by us to you was formed (i.e. at the point we send the Despatch Confirmation E-mail to you). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these On-line Shopping Terms and Conditions excludes our liability to you for personal injury or death caused by our negligence.
Events beyond our reasonable control
We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
Alterations to this Website and Terms and Conditions
We reserve the right at any time to make changes to this Website, these On-line Shopping Terms and Conditions, Privacy Statement and such other policies as we may notify you of. You will be subject to the policies and terms and conditions in force at the time you use the Website or order items from the Website. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.
If you breach these On-line Shopping Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
Governing Law and Jurisdiction
These On-line Shopping Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the English courts, as do we.

(3) AJ The Confectionist at their sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof.
(4) AJ The Confectionist at their sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.
(5) AJ The Confectionist will manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
If you access the Site from the European Union, Asia, or any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Site, you are transferring your data to the United Kingdom, and you expressly consent to have your data transferred to and processed in the United Kingdom.
